San Diego Public Law Library Offers Low Cost MCLE

Protecting Homeowners from Debt Collectors and Association Foreclosures

Learn about:

Types of assessments; how much can they go up a year?
State and federal laws that govern assessment collection.
Homeowner rights when the HOA board turns your count over to a debt collector; role of the property manager in collections.
Does the association have the power to foreclose - just like a bank?
Resources available to the homeowner, either to challenge the assessment itself or the debt collection process.
Obtaining the contract between the debt collector and the HOA.
Using small claims court to pay assessments under protest.
Court cases relating to assessment collection.

About the Speaker.

Consumer attorney Dan Mulligan is a nationally-known expert on debt collection and foreclosure. In November 2008, Mr. Mulligan’s law firm filed a class action lawsuit against Los Angeles-based assessment debt collector Association Lien Services (ALS). Lead plaintiff is a senior homeowner, who owns an Oakland condo.
